NAICJA's Judges Training Judges: Juvenile Probation
Longmont, Colorado * June 19 - 21, 2007




With limited jail space, and criminal dockets on the rise reflecting higher crime rates, suspended and split sentences are being more frequently used by tribal courts as a means of punishing offenders and protecting tribal communities. This training session explored the fundamentals of establishing the probation process, touch on supervision, including electonic monitoring and intermediate sanctions for probation/parole violators and center on the revocation hearings and due process requirements. Parole processes run parallel and stem from the executive function rather than a judicial process. Few tribes have parole as a tool and a few that do place it in the judicial system. Keeping both adult defendants and juveniles out of jail, but accountable is the goal of this training session.
